Proto jsme pro podnikatele p\u0159ipravili vstupn\u00ed GDPR audit, d\u00edky kter\u00e9mu nap\u0159ed situaci ve Va\u0161em podnik\u00e1n\u00ed zanalyzujeme a teprve pot\u00e9 budeme \u0159e\u0161it samotnou implementaci GDPR. \u00a0\u00a0<\/strong><\/p>\n<p><strong><u>Audit GDPR<\/u><\/strong><\/p>\n<p>Necht\u011bli jsme se d\u00e1t cestou drah\u00fdch audit\u016f, kdy podnikatel\u00e9 \u010dasto plat\u00ed za n\u011bco, co v\u016fbec nepot\u0159ebuj\u00ed. Proto vznikl vstupn\u00ed GDPR audit, kter\u00fd n\u00e1m umo\u017en\u00ed nap\u0159ed detailn\u011b poznat Va\u0161e podnik\u00e1n\u00ed a n\u00e1sledn\u011b navrhnout opat\u0159en\u00ed p\u0159esn\u011b podle Va\u0161ich pot\u0159eb.\u00a0<b>Nebudete tak platit nic, co nebudete pot\u0159ebovat<\/b>.<\/p>\n<p><strong><span lang=\"EN-GB\">&gt;&gt;&gt;\u00a0<\/span>Cena auditu je 14.900,- K\u010d &lt;&lt;&lt;<\/strong><\/p>\n<p><strong>1. Postup auditu<\/strong><\/p>\n<p>Za\u0161leme V\u00e1m<span class=\"apple-converted-space\">\u00a0<\/span><strong>analytickou matici <\/strong>(Excel tabulka) a<span class=\"apple-converted-space\">\u00a0<\/span><strong>manu\u00e1l<\/strong>, kter\u00fd V\u00e1m pom\u016f\u017ee matici vyplnit a provede V\u00e1s z\u00e1klady implementace GDPR (manu\u00e1l m\u016f\u017eete pou\u017e\u00edt i v\u00a0p\u0159\u00edpad\u011b, kdy se rozhodnete implementaci prov\u00e9st sami). Implementace GDPR bude realizov\u00e1na a\u017e na z\u00e1klad\u011b v\u00fdsledku auditu a <b>\u0159e\u0161en\u00ed tak bude\u00a0<\/b><b>\u0161it\u00e9 p\u0159esn\u011b na m\u00edru pot\u0159eb\u00e1m Va\u0161eho podnik\u00e1n\u00ed<\/b>.<\/p>\n<p>V\u00a0neposledn\u00ed \u0159ad\u011b d\u00edky auditu zjist\u00edte, jak Va\u0161e spole\u010dnost s\u00a0osobn\u00edmi \u00fadaji nakl\u00e1d\u00e1 a Vy tak m\u016f\u017eete odhalit i neefektivn\u00ed procesy, kter\u00e9 Va\u0161e podnik\u00e1n\u00ed brzd\u00ed.<\/p>\n<p><strong><u>Komplexn\u00ed implementace GDPR<\/u><\/strong><\/p>\n<p>N\u00e1\u0161 audit je koncipov\u00e1n jako vstupn\u00ed a jeho prim\u00e1rn\u00edm \u00fa\u010delem je z\u00edskat p\u0159ehled o nakl\u00e1d\u00e1n\u00ed s\u00a0osobn\u00edmi \u00fadaji ve Va\u0161\u00ed spole\u010dnosti a navrhnout konkr\u00e9tn\u00ed opat\u0159en\u00ed k\u00a0implementaci GDPR.<\/p>\n<p>Pokud byste m\u011bli z\u00e1jem o komplexn\u00ed implementaci GDPR (tedy i audit jako takov\u00fd bychom prov\u00e1d\u011bli osobn\u011b p\u0159\u00edmo ve Va\u0161\u00ed spole\u010dnosti), m\u016f\u017eete se na n\u00e1s samoz\u0159ejm\u011b obr\u00e1tit. Je ale t\u0159eba po\u010d\u00edtat s\u00a0t\u00edm, \u017ee cena takov\u00e9ho auditu bude za\u010d\u00ednat na cen\u011b 55.000,- K\u010d.<\/p>\n<p><b><u>Stru\u010dn\u011b o GDPR<\/u><\/b><\/p>\n<p>GDPR (General Data Protection Regulation \u2013 obecn\u00e9 na\u0159\u00edzen\u00ed o ochran\u011b osobn\u00edch \u00fadaj\u016f) je na\u0159\u00edzen\u00edm Evropsk\u00e9 unie, kter\u00e9 nab\u00fdv\u00e1 \u00fa\u010dinnosti dnem 25. 5. 2018. Jeliko\u017e se jedn\u00e1 o evropsk\u00e9 na\u0159\u00edzen\u00ed, je nutn\u00e9 b\u00fdt s\u00a0n\u00edm v\u00a0souladu nejpozd\u011bji k\u00a0uveden\u00e9mu datu bez ohledu na to, zda \u010dlensk\u00e9 st\u00e1ty (v na\u0161em p\u0159\u00edpad\u011b \u010cesk\u00e1 republika) stihly p\u0159ijmout prov\u00e1d\u011bc\u00ed pr\u00e1vn\u00ed p\u0159edpisy (\u010cesk\u00e1 republika to nestihla).<\/p>\n<p>Z\u00a0pohledu ochrany osobn\u00edch \u00fadaj\u016f se jedn\u00e1 sp\u00ed\u0161e evoluci ne\u017e revoluci. Podnikatel\u00e9 \u0159\u00e1dn\u011b pln\u00edc\u00ed sv\u00e9 dosavadn\u00ed povinnost ve vztahu k ochran\u011b osobn\u00edch \u00fadaj\u016f nebudou m\u00edt v\u011bt\u0161\u00ed pot\u00ed\u017ee ani po 25. 5. 2018. Velmi \u010dast\u00e1 je tak i ot\u00e1zka, jak od takov\u00e9 smlouvy odstoupit a jak\u00e1 pr\u00e1va a povinnosti spot\u0159ebitel\u00e9 v takov\u00e9m p\u0159\u00edpad\u011b maj\u00ed.<\/p>\n<p>Na internetu lze nal\u00e9zt nep\u0159ebern\u00e9 mno\u017estv\u00ed \u010dl\u00e1nk\u016f s\u00a0radami. Ne ka\u017ed\u00fd m\u00e1 ale \u010das a chu\u0165 \u010d\u00edst s\u00e1hodlouh\u00e9 pr\u00e1vnick\u00e9 trakt\u00e1ty, jen aby na\u0161el mezi v\u0161emi t\u011bmi odpov\u011b\u010fmi tu, kterou zrovna pot\u0159ebuje. Zku\u0161ebn\u00ed doba je z\u00e1konem dan\u00e1 lh\u016fta, aby si zam\u011bstnavatel mohl otestovat nov\u00e9ho zam\u011bstnance, ale sou\u010dasn\u011b slou\u017e\u00ed i zam\u011bstnanci, kter\u00fd tak m\u00e1 \u010das se s\u00a0nov\u00fdm zam\u011bstn\u00e1n\u00edm sezn\u00e1mit a p\u0159\u00edpadn\u011b se rozhodnout, \u017ee mu nevyhovuje.<\/strong><\/p>\n<p><strong><u>Sjedn\u00e1n\u00ed a d\u00e9lka zku\u0161ebn\u00ed doby<\/u><\/strong><\/p>\n<p>Oproti za\u017eit\u00e9mu n\u00e1zoru nen\u00ed zku\u0161ebn\u00ed doba automaticky sou\u010d\u00e1st\u00ed ka\u017ed\u00e9ho pracovn\u011bpr\u00e1vn\u00edho vztahu. Zku\u0161ebn\u00ed dobu je nutn\u00e9 sjednat nejpozd\u011bji v\u00a0den n\u00e1stupu do zam\u011bstn\u00e1n\u00ed (nej\u010dast\u011bji p\u0159\u00edmo v\u00a0pracovn\u00ed smlouv\u011b). <strong>Pokud s\u00a0V\u00e1mi zam\u011bstnavatel zku\u0161ebn\u00ed dobu v\u00fdslovn\u011b nesjedn\u00e1, tak tato ani nevznikne<\/strong>.<\/p>\n<p>Standardn\u00ed d\u00e9lka zku\u0161ebn\u00ed doby jsou pak 3 m\u011bs\u00edce (6 m\u011bs\u00edc\u016f u vedouc\u00edch zam\u011bstnanc\u016f), kdy se m\u016f\u017eete se zam\u011bstnavatelem dohodnout na krat\u0161\u00ed dob\u011b. Je ale nep\u0159\u00edpustn\u00e9 zku\u0161ebn\u00ed dobu prodlu\u017eovat. Zku\u0161ebn\u00ed dobu nen\u00ed mo\u017en\u00e9 sjednat u dohod o pracovn\u00ed \u010dinnosti nebo o proveden\u00ed pr\u00e1ce.<\/p>\n<p><strong><u>Pozor na triky<\/u><\/strong><\/p>\n<p>Jak jsme psali v\u00fd\u0161e, nen\u00ed dovolen\u00e9 zku\u0161ebn\u00ed dobu prodlu\u017eovat. Zam\u011bstnavatel\u00e9 n\u011bkdy zkou\u0161\u00ed sv\u00e9 zam\u011bstnance p\u0159esv\u011bd\u010dit k\u00a0rozv\u00e1z\u00e1n\u00ed sou\u010dasn\u00e9ho pracovn\u00edho pom\u011bru a obratem se zam\u011bstnancem uzav\u0159ou dal\u0161\u00ed pracovn\u00ed smlouvu s\u00a0novou zku\u0161ebn\u00ed dobou. Tento postup v\u0161ak nen\u00ed v\u00a0po\u0159\u00e1dku a rozhodn\u011b ho odm\u00edtn\u011bte. Podobn\u011b je \u010dast\u00e9 p\u0159eveden\u00ed zam\u011bstnance na jinou pr\u00e1ci, kdy zam\u011bstnavatel spolu se souvisej\u00edc\u00ed zm\u011bnou pracovn\u00ed smlouvy chce stanovit i novou zku\u0161ebn\u00ed dobu. To v\u0161ak tak\u00e9 nen\u00ed dovolen\u00e9.<\/p>\n<p><strong><u>Jak se br\u00e1nit v\u00fdpov\u011bdi ve zku\u0161ebn\u00ed dob\u011b?<\/u><\/strong><\/p>\n<p>V\u00a0p\u0159\u00edpad\u011b ukon\u010den\u00ed pracovn\u00edho pom\u011bru ve zku\u0161ebn\u00edho dob\u011b bohu\u017eel neexistuje \u017e\u00e1dn\u00fd trik. Zam\u011bstnanec m\u016f\u017ee d\u00e1t v\u00fdpov\u011b\u010f ve zku\u0161ebn\u00ed dob\u011b kdykoli a nepot\u0159ebuje k\u00a0tomu \u017e\u00e1dn\u00fd d\u016fvod. Pokud tuto lh\u016ftu zam\u011bstnavatel nedodr\u017e\u00ed, je v\u00fdpov\u011b\u010f neplatn\u00e1 (pokud v\u0161ak d\u00e1 zam\u011bstnanci v\u00fdpov\u011b\u010f ve t\u0159et\u00edm t\u00fddnu pracovn\u00ed neschopnosti, je ji\u017e v\u00fdpov\u011b\u010f platn\u00e1).<\/p>\n<p><strong>V\u00fdpov\u011b\u010f mus\u00ed b\u00fdt v\u017edy p\u00edsemn\u00e1, podepsan\u00e1 a mus\u00ed z\u00a0n\u00ed b\u00fdt patrn\u00e9 kdo ji \u010din\u00ed a komu ji adresuje<\/strong>. Ztr\u00e1ta zam\u011bstn\u00e1n\u00ed je zajist\u00e9 velmi nep\u0159\u00edjemn\u00e1, ale je tak\u00e9 pot\u0159eba myslet na to, \u017ee z\u00e1kon\u00edk pr\u00e1ce d\u016fsledn\u011b chr\u00e1n\u00ed pr\u00e1va zam\u011bstnanc\u016f. Pokud zam\u011bstnavatel nedodr\u017e\u00ed ustanoven\u00ed z\u00e1kon\u00edku pr\u00e1ce, je v\u00fdpov\u011b\u010f neplatn\u00e1 a Vy m\u00e1te m\u00e1 pr\u00e1vo v\u00a0zam\u011bstn\u00e1n\u00ed z\u016fstat, a nav\u00edc na zp\u011btn\u00e9 doplacen\u00ed mzdy.<\/strong><\/p>\n<p><strong><u>Kdy je v\u00fdpov\u011b\u010f zam\u011bstnavatele neplatn\u00e1?<\/u><\/strong><\/p>\n<p>Stejn\u011b jako v\u00a0p\u0159\u00edpad\u011b v\u00fdpov\u011bdi ze strany zam\u011bstnance (v\u00fdpov\u011bdi zam\u011bstnance jsme se bl\u00ed\u017eeji v\u011bnovali v tomto\u00a0<a href=\"http:\/\/akchocholousek.cz\/vypoved-pracovniho-pomeru-vzor\/\">\u010dl\u00e1nku<\/a>) je nutn\u00e9, aby byla v\u00fdpov\u011b\u010f ze strany zam\u011bstnavatele <strong>p\u00edsemn\u00e1<\/strong>. Na rozd\u00edl od zam\u011bstnance v\u0161ak <strong>zam\u011bstnavatel m\u016f\u017ee zam\u011bstnanci ud\u011blit v\u00fdpov\u011b\u010f jen z\u00a0pevn\u011b dan\u00fdch d\u016fvod\u016f<\/strong>, kter\u00e9 popisujeme v\u00a0dal\u0161\u00edm odstavci. Tyto d\u016fvody pak samoz\u0159ejm\u011b mus\u00ed existovat a zam\u011bstnavatel je mus\u00ed b\u00fdt schopen \u0159\u00e1dn\u011b dolo\u017eit.<\/p>\n<p><strong><u>Jak\u00e9 jsou d\u016fvody k\u00a0v\u00fdpov\u011bdi ze strany zam\u011bstnavatele?<\/u><\/strong><strong>\u00a0<\/strong><\/p>\n<p><strong>1. Organiza\u010dn\u00ed zm\u011bny<\/strong><\/p>\n<p>T\u00edmto pojmem se rozum\u00ed tzv. \u201enadbyte\u010dnost\u201c zam\u011bstnance, kdy na z\u00e1klad\u011b konkr\u00e9tn\u00edho rozhodnut\u00ed zam\u011bstnavatele doch\u00e1z\u00ed k\u00a0organiza\u010dn\u00edm zm\u011bn\u00e1m (nap\u0159. ru\u0161en\u00ed odd\u011blen\u00ed), kter\u00e9 p\u0159edch\u00e1zely ud\u011blen\u00ed v\u00fdpov\u011bdi zam\u011bstnanci (<strong>nesm\u00ed se tak jednat o p\u0159edst\u00edran\u00e9 zm\u011bny pouze za \u00fa\u010delem propu\u0161t\u011bn\u00ed konkr\u00e9tn\u00edho zam\u011bstnance<\/strong>).<\/p>\n<p><strong>2. Neuspokojiv\u00e9 pracovn\u00ed v\u00fdsledky<\/strong><\/p>\n<p>Tento d\u016fvod m\u016f\u017ee zam\u011bstnavatel pou\u017e\u00edt pouze v\u00a0p\u0159\u00edpad\u011b, kdy zam\u011bstnance v\u00a0posledn\u00edch 12 m\u011bs\u00edc\u00edch <strong>p\u00edsemn\u011b vyzval k\u00a0n\u00e1prav\u011b<\/strong> nedostatk\u016f ve v\u00fdkonu jeho pr\u00e1ce a <strong>zam\u011bstnanec tyto nedostatky v\u00a0p\u0159im\u011b\u0159en\u00e9 lh\u016ft\u011b nenapravil<\/strong>. Zam\u011bstnavatel v\u0161ak nem\u016f\u017ee sv\u00e9voln\u011b stanovat c\u00edle, kter\u00e9 zam\u011bstnanec mus\u00ed dos\u00e1hnout. \u00dadajn\u011b neuspokojiv\u00e9 pracovn\u00ed v\u00fdsledky je tak nutn\u00e9 posuzovat i s\u00a0ohledem na jejich ospravedlnitelnost a p\u0159im\u011b\u0159enost.<\/p>\n<p><strong>3. Poru\u0161en\u00ed povinnost\u00ed zam\u011bstnancem<\/strong><\/p>\n<p>Chronicky zn\u00e1m\u00e9 je <strong>okam\u017eit\u00e9 rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru<\/strong> (v\u00fdpov\u011b\u010f na hodinu), kdy se jedn\u00e1 o velmi z\u00e1va\u017en\u00e9 poru\u0161en\u00ed povinnost\u00ed zam\u011bstnancem. Takov\u00fdm z\u00e1va\u017en\u00fdm poru\u0161en\u00edm je pak nap\u0159. fyzick\u00e9 napaden\u00ed kolegy, siln\u00e1 podnapilost nebo okraden\u00ed zam\u011bstnavatele. Jedn\u00e1 se tedy o skute\u010dn\u011b z\u00e1va\u017en\u00e9 proh\u0159e\u0161ky.<\/p>\n<p>Nicm\u00e9n\u011b i za <strong>m\u00e9n\u011b z\u00e1va\u017en\u00e9 poru\u0161ov\u00e1n\u00ed povinnost\u00ed<\/strong> lze zam\u011bstnance propustit. V\u00a0tomto p\u0159\u00edpad\u011b v\u0161ak mus\u00ed j\u00edt o soustavn\u00e9 poru\u0161ov\u00e1n\u00ed povinnost\u00ed a zam\u011bstnavatel musel v\u00a0uplynul\u00fdch 6 m\u011bs\u00edc\u00edch p\u0159ed ud\u011blen\u00edm v\u00fdpov\u011bdi zam\u011bstnance na toto poru\u0161ov\u00e1n\u00ed upozornit (ud\u011blit tzv. v\u00fdtku) a poskytnout zam\u011bstnanci p\u0159im\u011b\u0159enou lh\u016ftu k n\u00e1prav\u011b. Je ale pot\u0159eba v\u011bd\u011bt, \u017ee zam\u011bstnavatel m\u016f\u017ee postihnout poru\u0161ov\u00e1n\u00ed povinnost\u00ed zam\u011bstnancem zp\u011btn\u011b. Tento postih &#8222;se zpo\u017ed\u011bn\u00edm&#8220; je v\u0161ak omezen lh\u016ftou 2 m\u011bs\u00edce ode dne, kdy se zam\u011bstnavatel o poru\u0161ov\u00e1n\u00ed povinnost\u00ed dozv\u011bd\u011bl, nejpozd\u011bji v\u0161ak 1 rok od doby, kdy k poru\u0161en\u00ed povinnost\u00ed do\u0161lo (pokud se tedy zam\u011bstnavatel o poru\u0161en\u00ed povinnosti ze strany zam\u011bstnance dozv\u00ed po 1 m\u011bs\u00edci, nen\u00ed zam\u011bstnanec z\u00a0obliga).<\/p>\n<p><strong>4. Zam\u011bstnanec p\u0159estal spl\u0148ovat po\u017eadavky k\u00a0v\u00fdkonu zam\u011bstn\u00e1n\u00ed<\/strong><\/p>\n<p>Jedn\u00e1 se o situace, kdy zam\u011bstnanec mus\u00ed spl\u0148ovat konkr\u00e9tn\u00ed po\u017eadavky k\u00a0v\u00fdkonu sv\u00e9ho povolan\u00ed (nap\u0159. m\u00edt \u0159idi\u010dsk\u00fd pr\u016fkaz). Pokud tyto po\u017eadavky zam\u011bstnanec ji\u017e nad\u00e1le nespl\u0148uje, m\u016f\u017ee mu zam\u011bstnavatel d\u00e1t v\u00fdpov\u011b\u010f. <strong>Zam\u011bstnavatel je ale povinen nap\u0159ed zam\u011bstnanci d\u00e1t p\u0159im\u011b\u0159enou lh\u016ftu k\u00a0n\u00e1prav\u011b<\/strong>.<\/p>\n<p><strong><u>Kdy nen\u00ed mo\u017en\u00e9 zam\u011bstnanci d\u00e1t v\u00fdpov\u011b\u010f?<\/u><\/strong><\/p>\n<p>Pokud je zam\u011bstnanec v\u00a0pracovn\u00ed neschopnosti, nebo se jedn\u00e1 o t\u011bhotnou \u017eenu, \u010di zam\u011bstnance na mate\u0159sk\u00e9 dovolen\u00e9, nem\u016f\u017ee mu zam\u011bstnavatel ud\u011blit v\u00fdpov\u011b\u010f. Takov\u00fd zam\u011bstnanec je tak ze z\u00e1kona \u201echr\u00e1n\u011bn\u00fd\u201c. To se v\u0161ak net\u00fdk\u00e1 zam\u011bstnance ve zku\u0161ebn\u00ed dob\u011b, na kter\u00e9ho se zm\u00edn\u011bn\u00e1 \u201eochrana\u201c vztahuje pouze po dobu prvn\u00edch 14 dn\u016f pracovn\u00ed neschopnosti.<\/p>\n<p><strong><u>Co d\u011blat po obdr\u017een\u00ed v\u00fdpov\u011bdi?<\/u><\/strong><\/p>\n<p>Pokud je v\u00fdpov\u011b\u010f neplatn\u00e1 (zam\u011bstnavatel tedy nem\u011bl k ud\u011blen\u00ed v\u00fdpov\u011bdi \u017e\u00e1dn\u00fd z v\u00fd\u0161e uveden\u00fdch d\u016fvod\u016f) a Vy se j\u00ed chcete br\u00e1nit, je nutn\u00e9 <strong>co nejd\u0159\u00edve<\/strong> <strong>p\u00edsemn\u011b<\/strong> sd\u011blit zam\u011bstnavateli, \u017ee pova\u017eujete v\u00fdpov\u011b\u010f za neplatnou a trv\u00e1te na tom, aby V\u00e1s nad\u00e1le zam\u011bstn\u00e1val (sta\u010d\u00ed jednoduch\u00fd dopis). <strong>Bez Va\u0161eho aktivn\u00edho p\u0159\u00edstupu m\u016f\u017ee b\u00fdt i neplatn\u00e1 v\u00fdpov\u011b\u010f \u00fa\u010dinn\u00e1<\/strong>.<\/p>\n<p>Pokud V\u00e1\u0161 zam\u011bstnavatel nad\u00e1le bude trvat na platnosti v\u00fdpov\u011bdi, je nutn\u00e9 <strong>podat k\u00a0soudu \u017ealobu<\/strong> na neplatnost v\u00fdpov\u011bdi. Tuto \u017ealobu je nutn\u00e9 podat <strong>do 2 m\u011bs\u00edc\u016f<\/strong> od dne, kdy m\u011bl V\u00e1\u0161 pracovn\u00ed pom\u011br podle napadan\u00e9 v\u00fdpov\u011bdi skon\u010dit (pokud tedy m\u011bl V\u00e1\u0161 pracovn\u00ed pom\u011br skon\u010dit k\u00a031. b\u0159eznu, je nutn\u00e9 \u017ealobu podat nejpozd\u011bji 31. kv\u011btna).<\/p>\n<p>Soud se pak bude zab\u00fdvat platnost\u00ed v\u00fdpov\u011bdi a pokud dojde k\u00a0z\u00e1v\u011bru, \u017ee je skute\u010dn\u011b neplatn\u00e1, V\u00e1\u0161 pracovn\u00ed pom\u011br bude nad\u00e1le trvat a zam\u011bstnavatel V\u00e1m bude muset doplatit ve\u0161kerou u\u0161lou mzdu od momentu ud\u011blen\u00ed v\u00fdpov\u011bdi a\u017e do okam\u017eiku op\u011btovn\u00e9ho n\u00e1stupu do pr\u00e1ce (m\u016f\u017ee se tak jednat i o statis\u00edcov\u00e9 \u010d\u00e1stky).<\/p>\n<p><strong><u>Pomoc odborn\u00edka<\/u><\/strong><\/p>\n<p>Pokud se chcete br\u00e1nit v\u00fdpov\u011bdi br\u00e1nit, vyu\u017eijte slu\u017ebu <strong>Pracovn\u00ed pr\u00e1vo<\/strong>\u00a0(slu\u017eba <strong>Dostal\/a jsem v\u00fdpov\u011b\u010f<\/strong>). Dozv\u00edte se, co se vlastn\u011b pod t\u00edmto pojmem skr\u00fdv\u00e1, na co si d\u00e1t p\u0159i jej\u00edm podpisu pozor a jak\u00e1 jsou Va\u0161e pr\u00e1va.<\/strong><\/p>\n<p><strong><u>Co je vlastn\u011b v\u00fdpov\u011b\u010f dohodou?<\/u><\/strong><\/p>\n<p>By\u0165 je \u201ev\u00fdpov\u011b\u010f dohodou\u201c v\u00a0\u010cesk\u00e9 republice velmi obl\u00edbena, jedn\u00e1 se o term\u00edn, kter\u00fd z\u00a0pohledu pracovn\u00edho pr\u00e1va neexistuje. Pracovn\u00ed pom\u011br lze ukon\u010dit bud\u02c7 v\u00fdpov\u011bd\u00ed anebo dohodou. Ona slavn\u00e1 \u201ev\u00fdpov\u011b\u010f dohodou\u201c je z\u00a0pohledu pr\u00e1va jednodu\u0161e dohodou o rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru (v \u010dl\u00e1nku ji budeme naz\u00fdvaz jednodu\u0161e dohodou).<\/p>\n<p>Mezi \u010desk\u00fdmi zam\u011bstnavateli je pak obl\u00edben\u00fdm sportem v\u00a0dohod\u00e1ch neuv\u00e1d\u011bt d\u016fvod rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru a zam\u011bstnanc\u016fm nep\u0159iznat pr\u00e1vo na odstupn\u00e9. Pro\u010d je tento postup protipr\u00e1vn\u00ed si \u0159ekneme n\u00ed\u017ee.<\/p>\n<p><strong><u>Dohoda a odstupn\u00e9<\/u><\/strong><\/p>\n<p>Pro odstupn\u00e9 v\u00a0p\u0159\u00edpad\u011b dohody plat\u00ed stejn\u00e1 pravidla jako pro v\u00fdpov\u011b\u010f ze strany zam\u011bstnavatele (odstupn\u00fdm jsme se zab\u00fdvali v tomto\u00a0<a href=\"http:\/\/akchocholousek.cz\/odstupne-2018\/\">\u010dl\u00e1nku<\/a>). Pokud jsou tedy skute\u010dn\u00fdm d\u016fvodem, pro\u010d s\u00a0V\u00e1mi zam\u011bstnavatel uzav\u0159el dohodu, tzv. organiza\u010dn\u00ed zm\u011bny (nadbyte\u010dnost zam\u011bstnance), m\u00e1te pr\u00e1vo na odstupn\u00e9 v\u00a0pln\u00e9 v\u00fd\u0161i, a to bez ohledu na to, zda je v\u00a0dohod\u011b uveden d\u016fvod k\u00a0rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru.<\/p>\n<p>Samotn\u00fd d\u016fvod k\u00a0rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru pak v\u00a0dohod\u011b b\u00fdt uveden nemus\u00ed, ale <strong>m\u00e1te pr\u00e1vo jeho uveden\u00ed po\u017eadovat<\/strong>, co\u017e i doporu\u010dujeme.<\/p>\n<p><strong><u>P\u0159\u00edklad<\/u><\/strong><\/p>\n<p>Se zam\u011bstnavatelem podep\u00ed\u0161ete tzv. v\u00fdpov\u011b\u010f dohodou, ve kter\u00e9 nebude uveden d\u016fvod rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru, nebo bude v dohod\u011b uveden\u00fd d\u016fvod z\u00e1stupn\u00fd. Aby toho nebylo m\u00e1lo, zam\u011bstnavatel V\u00e1m sou\u010dasn\u011b odm\u00edtne poskytnout odstupn\u00e9 a bude tvrdit, \u017ee na n\u011bj nem\u00e1te pr\u00e1vo. Nicm\u00e9n\u011b v\u00edte, \u017ee prav\u00fdm d\u016fvodem v\u00fdpov\u011bdi jsou organiza\u010dn\u00ed zm\u011bny, kdy zam\u011bstnavatel ru\u0161\u00ed Va\u0161e odd\u011blen\u00ed.<\/p>\n<p>Ve v\u00fd\u0161e uveden\u00e9m p\u0159\u00edpad\u011b V\u00e1m tak <strong>n\u00e1rok na odstupn\u00e9 vznikl a nen\u00ed rozhoduj\u00edc\u00ed, \u017ee organiza\u010dn\u00ed d\u016fvody nejsou v\u00a0dohod\u011b zm\u00edn\u011bny<\/strong>. V\u00a0p\u0159\u00edpad\u011b ukon\u010den\u00ed pracovn\u00edho pom\u011bru dohodou se pak naopak mnoho lid\u00ed domn\u00edv\u00e1, \u017ee n\u00e1rok na odstupn\u00e9 nemaj\u00ed, a p\u0159itom opak je \u010dasto pravdou.<\/p>\n<p>Aby zam\u011bstnanci vznikl n\u00e1rok na odstupn\u00e9, mus\u00ed doj\u00edt k\u00a0ukon\u010den\u00ed pracovn\u00edho pom\u011bru z\u00a0d\u016fvod\u016f, kter\u00e9 <strong>nejsou zavin\u011bn\u00e9 zam\u011bstnancem<\/strong> (n\u00e1rok nap\u0159. nevznikne v situaci, kdy zam\u011bstnanec bude propu\u0161t\u011bn kv\u016fli poru\u0161en\u00ed sv\u00fdch povinnost\u00ed). <strong>N\u00e1rok naopak vznikne, pokud byl pracovn\u00ed pom\u011br ukon\u010den\u00a0kv\u016fli organiza\u010dn\u00edm zm\u011bn\u00e1m na stran\u011b zam\u011bstnavatele<\/strong>.<\/p>\n<p><strong>N\u00e1rok na odstupn\u00e9 d\u00e1le nevznik\u00e1<\/strong> v\u00a0p\u0159\u00edpad\u011b ukon\u010den\u00ed pracovn\u00edho pom\u011bru ve zku\u0161ebn\u00ed dob\u011b, v\u00a0p\u0159\u00edpad\u011b v\u00fdpov\u011bdi ze strany zam\u011bstnance (jak jsme psali v\u00fd\u0161e) a v\u00a0p\u0159\u00edpad\u011b dohod o proveden\u00ed pr\u00e1ce a o pracovn\u00ed \u010dinnosti.<\/p>\n<p><strong><u>Jak je to s\u00a0odstupn\u00fdm v\u00a0p\u0159\u00edpad\u011b dohody o ukon\u010den\u00ed pracovn\u00edho pom\u011bru?<\/u><\/strong><\/p>\n<p>Z\u00a0dohody o ukon\u010den\u00ed pracovn\u00edho pom\u011bru dohodou <strong>vznik\u00e1 zam\u011bstnanci n\u00e1rok na odstupn\u00e9, pokud k\u00a0rozv\u00e1z\u00e1n\u00ed pracovn\u00edho pom\u011bru doch\u00e1z\u00ed z\u00a0d\u016fvod\u016f na stran\u011b zam\u011bstnavatele<\/strong> (nap\u0159. organiza\u010dn\u00ed d\u016fvody) a nen\u00ed rozhodn\u00e9, zda tyto d\u016fvody jsou v\u00a0textu dohody skute\u010dn\u011b uvedeny (<strong>m\u00e1te ale pr\u00e1vo na to, aby byly d\u016fvody v\u00a0dohod\u011b pops\u00e1ny<\/strong>). Nenechte se tedy obalamutit t\u00edm, \u017ee v\u00a0dohod\u011b chyb\u00ed d\u016fvod ukon\u010den\u00ed pracovn\u00edho pom\u011bru a zam\u011bstnavatel bude odm\u00edtat V\u00e1\u0161 n\u00e1rok na odstupn\u00e9.<\/p>\n<p><strong><u>Jak\u00e1 je v\u00fd\u0161e odstupn\u00e9ho?<\/u><\/strong><\/p>\n<p>V\u00fd\u0161e odstupn\u00e9ho se odv\u00edj\u00ed od Va\u0161eho pr\u016fm\u011brn\u00e9ho v\u00fdd\u011blku za posledn\u00ed kalend\u00e1\u0159n\u00ed \u010dtvrtlet\u00ed (pr\u016fm\u011br v\u0161ech p\u0159\u00edjm\u016f v\u00e1zan\u00fdch p\u0159\u00edmo na v\u00fdkon pr\u00e1ce pro zam\u011bstnavatele) a jeho konkr\u00e9tn\u00ed v\u00fd\u0161e se ur\u010duje podle d\u00e9lky Va\u0161eho pracovn\u00edho pom\u011bru. Jeliko\u017e z\u00e1kon\u00edk pr\u00e1ce chr\u00e1n\u00ed pr\u00e1va zam\u011bstnanc\u016f, nejsou ani n\u00e1le\u017eitosti v\u00fdpov\u011bdi podan\u00e9 zam\u011bstnancem slo\u017eit\u00e9, a dokonce ani <strong>nemus\u00edte uv\u00e1d\u011bt jak\u00fdkoli d\u016fvod v\u00fdpov\u011bdi<\/strong>. P\u00e1r po\u017eadavk\u016f ale p\u0159eci jen splnit mus\u00edte.<\/p>\n<p>Pamatujte ale, \u017ee v\u00a0p\u0159\u00edpad\u011b Va\u0161\u00ed v\u00fdpov\u011bdi (tedy nepodanou zam\u011bstnavatelem) <strong>nem\u00e1te n\u00e1rok na odstupn\u00e9<\/strong> (o odstupn\u00e9m jsme psali v tomto\u00a0<a href=\"http:\/\/akchocholousek.cz\/odstupne-2018\/\">\u010dl\u00e1nku<\/a>).<\/p>\n<p><strong><u>Z\u00e1kladn\u00ed n\u00e1le\u017eitosti v\u00fdpov\u011bdi<\/u><\/strong><\/p>\n<p>V\u00fdpov\u011b\u010f mus\u00ed b\u00fdt v\u017edy <strong>p\u00edsemn\u00e1<\/strong> a je pot\u0159eba ji <strong>\u0159\u00e1dn\u011b doru\u010dit<\/strong> Va\u0161emu zam\u011bstnavateli. Nechte si jej\u00ed p\u0159evzet\u00ed p\u00edsemn\u011b potvrdit, nebo ji za\u0161lete doporu\u010den\u011b po\u0161tou a uschovejte si dodac\u00ed l\u00edstek. V\u00fdpov\u011b\u010f samotn\u00e1 pak mus\u00ed obsahovat <strong>identifikaci Va\u0161\u00ed osoby<\/strong> (jm\u00e9no, datum narozen\u00ed a bydli\u0161t\u011b), <strong>datum<\/strong> a V\u00e1\u0161 <strong>podpis<\/strong>. V\u0161echny uveden\u00e9 n\u00e1le\u017eitosti jsou samoz\u0159ejm\u011b obsa\u017eeny i v\u00a0na\u0161em vzoru v\u00fdpov\u011bdi zdarma.<\/p>\n<p><strong><u>Kdy pracovn\u00ed pom\u011br skon\u010d\u00ed?<\/u><\/strong><\/p>\n<p>V\u00e1\u0161 pracovn\u00ed pom\u011br skon\u010d\u00ed po uplynut\u00ed dvoum\u011bs\u00ed\u010dn\u00ed v\u00fdpov\u011bdn\u00ed doby. Je ale v\u017edy pot\u0159eba zkontrolovat Va\u0161i pracovn\u00ed smlouvu, zda nen\u00ed v\u00fdpov\u011bdn\u00ed doba del\u0161\u00ed (nesm\u00ed b\u00fdt v\u0161ak krat\u0161\u00ed). V\u00fdpov\u011bdn\u00ed doba za\u010dne b\u011b\u017eet prvn\u00edm dnem m\u011bs\u00edce n\u00e1sleduj\u00edc\u00edho po dni pod\u00e1n\u00ed v\u00fdpov\u011bdi a skon\u010d\u00ed posledn\u00edm dnem m\u011bs\u00edce ur\u010den\u00e9ho v\u00a0z\u00e1vislosti na d\u00e9lce v\u00fdpov\u011bdn\u00ed doby (pokud tedy dvoum\u011bs\u00ed\u010dn\u00ed v\u00fdpov\u011b\u010f pod\u00e1te v\u00a0pr\u016fb\u011bhu ledna, za\u010dne v\u00fdpov\u011bdn\u00ed lh\u016fta b\u011b\u017eet a\u017e v\u00a0\u00fanoru a Va\u0161e zam\u011bstn\u00e1n\u00ed skon\u010d\u00ed 31. b\u0159ezna). Je ale pot\u0159eba myslet i na v\u00fdjimky, jako je nap\u0159. Va\u0161e nemoc, kdy o dobu pracovn\u00ed neschopnosti se v\u00fdpov\u011bdn\u00ed lh\u016fta prodlu\u017euje (pokud konec v\u00fdpov\u011bdn\u00ed doby spad\u00e1 na dobu trv\u00e1n\u00ed nemoci).<\/p>\n<p><strong>Pokud chcete, aby Va\u0161e zam\u011bstn\u00e1n\u00ed skon\u010dilo d\u0159\u00edve, je nutn\u00e9 se dohodnout s\u00a0Va\u0161\u00edm zam\u011bstnavatelem<\/strong>, kter\u00fd s\u00a0t\u00edm mus\u00ed souhlasit. Jinak to v\u017edy budou nejm\u00e9n\u011b 2 m\u011bs\u00edce, kter\u00e9 mus\u00edte dodr\u017eet, jinak V\u00e1m bude hrozit ze strany zam\u011bstnavatele postih.<\/p>\n<p><strong><u>Co v\u00fdpov\u011b\u010f dohodou?<\/u><\/strong><\/p>\n<p>Na ukon\u010den\u00ed pracovn\u00edho pom\u011bru se rovn\u011b\u017e m\u016f\u017eete se zam\u011bstnavatelem dohodnout (m\u016f\u017eete se nap\u0159. dohodnout, \u017ee v\u00a0pr\u00e1ci skon\u010d\u00edte v\u00a0jak\u00fdkoli den bez v\u00fdpov\u011bdn\u00ed doby). Je to ale ji\u017e dvoustrann\u00e9 pr\u00e1vn\u00ed jedn\u00e1n\u00ed. O \u00faskal\u00edch tzv. \u201ev\u00fdpov\u011bdi dohodou\u201c p\u00ed\u0161eme v tomto <a href=\"http:\/\/akchocholousek.cz\/vypoved-dohodou\/\">\u010dl\u00e1nku<\/a>.<\/p>\n<p><strong><u>Co kdy\u017e m\u00e1m konkuren\u010dn\u00ed dolo\u017eku?<\/u><\/strong><\/p>\n<p>Konkuren\u010dn\u00ed dolo\u017eka V\u00e1m nej\u010dast\u011bji po ur\u010ditou dobu (maxim\u00e1ln\u011b 1 rok) zamezuje ve v\u00fdd\u011ble\u010dn\u00e9 \u010dinnosti shodn\u00e9 s\u00a0p\u0159edm\u011btem podnik\u00e1n\u00ed va\u0161eho (b\u00fdval\u00e9ho) zam\u011bstnavatele. Stejn\u00e9 ale plat\u00ed i pro Va\u0161eho b\u00fdval\u00e9ho zam\u011bstnavatele, kter\u00fd V\u00e1m mus\u00ed za dodr\u017eov\u00e1n\u00ed konkuren\u010dn\u00ed dolo\u017eky platit dohodnut\u00e9 finan\u010dn\u00ed vyrovn\u00e1n\u00ed (nejm\u00e9n\u011b v\u0161ak ve v\u00fd\u0161i jedn\u00e9 poloviny pr\u016fm\u011brn\u00e9ho m\u011bs\u00ed\u010dn\u00edho v\u00fdd\u011blku, za ka\u017ed\u00fd m\u011bs\u00edc pln\u011bn\u00ed dolo\u017eky).
